Legal Definition of Incest

Incest is the act committed when a person marries or engages in sexual intercourse with a person, he/she knows to be either legitimately or illegitimacy:

  • His ancestor or descendant by blood or adoption
  • His whole or half-blooded brother or sister, or by adoption
  • His stepchild or stepparent, while the marriage creating the relationship still exists
  • His aunt or uncle, nephew or niece that is whole or half-blood.9

Incest Law

Even if the act of incest is consensual between both parties, incest is still considered a crime nationally. There is no specified age gap between the victim and the perpetrator, although acts of incest generally occur with an older perpetrator and a younger victim.
